Accessibility Statement

Vivaly is committed to making our app and website usable by everyone, including people with disabilities. We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, and to follow Apple's Human Interface Guidelines for accessibility on iOS. Accessibility is an ongoing effort, and we work to improve the experience continually.

We aim to respond within 5 business days and will work with you to provide the information or service you need through an alternative method where possible.

The Vivaly name, logo, wordmark, app and website design, the curated experience catalog, and all other content and materials we provide are owned by or licensed to Vivaly and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from our proprietary content without our prior written permission.

Content that you create and post remains yours. By posting it, you grant Vivaly the limited license described in our Terms of Service to operate the Service. You are responsible for ensuring that anything you post does not infringe anyone else's rights.

Copyright Infringement & DMCA Takedown

Vivaly respects the intellectual property rights of others and expects our users to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA).

Reporting infringement

If you believe content on Vivaly infringes your copyright, you can report it directly in the app — tap Report on the user, post, or experience and choose “Copyright or IP infringement” — or send a written notice to our designated agent at vivalyapp@gmail.com with the subject line “DMCA Notice.” To be effective, your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, with enough detail for us to locate it (e.g., a username, post, or experience and a description);
  4. Your contact information (name, address, telephone number, and email);
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Counter-notification

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notification to vivalyapp@gmail.com including: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; and your name, address, and phone number with consent to the jurisdiction of the appropriate court.

Repeat infringers

In appropriate circumstances, Vivaly will disable or terminate the accounts of users who are determined to be repeat infringers.
